By engaging with Ria Kona IT, you agree to use our services in compliance with all applicable laws and regulations. You agree to provide accurate, complete, and current information for the purposes of service delivery and billing.

You may not use our services for any unlawful purpose, or in a way that infringes the rights of others or restricts their use of the services.

Unless otherwise stated in a written statement of work, deliverables created specifically for you are licensed for your internal business use. All pre-existing intellectual property, frameworks, tools, and methodologies remain the exclusive property of Ria Kona IT.

Both parties agree to keep each other's confidential information secure and to use it solely for the purposes of the engagement. Confidential information will not be disclosed to third parties without prior written consent.

This obligation continues for a period of three years after the end of an engagement, unless the information becomes publicly available through no fault of either party.

To the extent permitted by applicable law, indirect, incidental, or consequential losses are excluded from our liability. Our aggregate liability in any claim is limited to the total fees paid to Ria Kona IT in the twelve months preceding the event giving rise to the claim.

Nothing in these terms excludes liability for fraud, personal injury caused by negligence, or any other liability that cannot be excluded by law.

Either party may terminate an engagement by providing written notice as specified in the relevant statement of work. Upon termination, any outstanding fees for work completed become immediately due.

Ria Kona IT reserves the right to suspend or terminate services immediately where there is a material breach of these terms or where continued service would be unlawful.

These terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the South African courts.
